Reason for Suit: Tort: Negligence, Constitutional Rights Violations
On July 6th my client, Martha Topp, was incapacitated in a shootout and moved to Pillbox Medical for treatment. After arriving at Pillbox Medical, it was determined that Mrs Topp would need to be put into the Intensive Care Unit. Martha Topp was then moved to Bolingbroke Penitentiary's infirmary by DoC, after being handed over by SAMS, where she was then left for 1 day without being charged. After this day had passed my client had woken still handcuffed to her infirmary bed. After roughly 90 minutes had elapsed, The BCSO had come down and released her from her cuffs. Then LSPD Officer Cortez came down and Martha was then charged by him on a warrant for the same charges they had put her in prison for and was thrown back into Bolingbroke for another sentence without contacting SAMS or any doctor to see if she was cleared to leave the ICU. After around 5 minutes the LSPD came back and commuted her sentence. We believe that this violates her 4th, 5th, 6th, and 8th amendment right.
