Reason for Suit: On or about the early morning of July 4th, Jack Burton made two arrests. Mercy Kandinsky was arrested and processed by Jack Burton at approximately 12:21 AM July 4th, and then Tim Timothy at approximately 4:21 AM July 4th. During the course of Jack Burton’s arrest of Mercy Kandinsky, he took her out by themselves to the windmill farm. Jack Burton proceeded to remove her from the vehicle, and have Mercy kneel in the dirt. Jack Burton then spoke in a way to intimidate Ms. Kandinsky. To wit, Burton said things along the lines of ‘You’re just a stupid criminal aren’t you?” “You’re never going to do anything bad again are you?”. After an extended conversation with more of the like, Burton took Kandinsky to a police department and processed her. Burton’s arrest of Timothy followed a little over 3 hours later. This time, Burton took Timothy to Roxwood pier, along with fellow officer Eddie Vercetti. Despite Vercetti’s pleas and advice, Burton continued on with this prolongment of a detainment, and spoke in a similar way to Mr. Tim Timothy as he just had to Ms. Kandinsky. The things said were largely similar, with a marked new phrase being introduced to Mr. Timothy. Jack Burton, according to Timothy, told Timothy that “No one would ever know if something were to happen to (Timothy).” Burton was first suspended by the LSPD for Mr. Timothy’s arrest within the first half of July. He was suspended a second time after his first suspension lapsed within the second half of July for his arrest of Kandinsky. We believe this constitutes a tort twofold: one for Constitutional Rights Violation of both Plaintiff’s 4th amendment right and 8th amendment right, and two for infliction of emotional distress.
