It appears that yourself and the Defendant have mismatched schedules. With this in mind, and in understanding that Mr. Gata does not intended to testify, it seems reasonable that we may be able to schedule for tomorrow, OCT 1, where most others are available and proceed in absence of Mr. Gata.
