On the counts of Reckless Endangerment & Vandalism our charge does not require intent BUT with this specific situation I believe there is enough reasonable doubt to say that intent does matter and considering the earthquake it is reasonable to believe that this motorcycle was released from the tow truck by no fault of the defendant, as the states own expert witness said they do not think you can release a vehicle while in the tow truck. For evading, when an officer stops you and you leave the detention, that is evading! UNLESS there is an immediate threat, such as a natural disaster. It's reasonable to say that they were getting off the bridge for their safety during this earthquake, as they did surrender peacefully, since there is no resisting arrest or anything else to say that they were attempting to resist. This is a very specific situation during a natural disaster and will not apply to 99% of the evading charges we see. We operate on Beyond a Reasonable doubt, and the defense has provided enough reasonable doubt that I can say Not Guilty on all charges.
