The plaintiff claims:
That Riley Reads, while acting as a Deputy of the Blaine County Sheriff’s Office, did knowingly violate the 4th Amendment rights of Pat Williams by means of unlawfully collecting a sample of his DNA while Pat Williams was held in custody within a Blaine County Sheriff’s Office located on Innocence Boulevard on March 26, 2025 at 05:50. Further basis for this claim is outlined below:
As per a recent DOJ Announcement issued by Justice Cassian Rose on March 17 2025, ONLY individuals being CHARGED with a VIOLENT FELONY may be subject to the collection of DNA samples without consent. The plaintiff was not charged with ANY violent felony in relation to his arrest on March 26, 2025 nor did he consent.
That Ms. Reads failed to obtain a court order or a warrant that would have otherwise permitted her to proceed with obtaining such a sample outside of the bounds of holdings under Maryland v. King.
That Ms. Reads’ written intentions of seeking a court order after-the-fact demonstrates willful acts intended to circumvent common law and a wanton disregard for the plaintiff’s civil rights.
That Ms. Reads is a sworn law enforcement officer, and is expected to be knowledgeable in the law and relevant applications thereof.
That Ms. Reads being under the employment of the Blaine County Sheriff’s Office at the time of this incident, and that said agency is responsible for providing their sworn officers with adequate training and supervision, that said agency is also liable for Ms. Reads’ actions.
The plaintiff seeks the following in relief:
That any and all samples of DNA collected in relation to his arrest on March 26 2025 be handed over to him or his legal counsel for destruction.
$20,000 USD in punitive and compensatory damages from Ms. Reads.
$20,00 USD in punitive and compensatory damages from the Blaine County Sheriff’s Office.
That Ms. Reads be required to undergo additional training in regards to unlawful search and seizures, and in general civil protections under the 4th Amendment, as proctored by a member of the Judiciary or District Attorney’s Office within 7 days of this matter being resolved.
