Ruling on the Probable Cause Hearing for The State v. Wingman Block
This Court finds Probable Cause for the following charges:
1x Aggravated Theft
1x Evading
1x Resisting Arrest
1x Theft
2x Attempted Murder of the Law Enforcement Officer
Aggregated factors such as Eye-witness testimony, fingerprints, and Positive Identification on-scene; this report and evidence submitted these charges have Probable Cause.
This Court does not find that there is Probable Cause for the following charge:
1x First Degree Murder of a Law Enforcement Officer.
The largest factor here is the mens rea behind the charge. There is Reasonable Suspicion for these charges, but nothing establishes, as written in our Penal Code, for Probable Cause on an arrest for this charge.
As such, all charges on this matter are currently Dismissed Without Prejudice.
A One(1) year voucher for jail time is granted to Mr. Block for the time spent in jail.
He is to be refunded for what was charged to him for all the other charges until such time as the State is ready to pull the trigger on this file for Mr. Block.
