Judge Name: Silas Grimmer
Clerk(s): Nym Shaw
DAO: Rob O'Cop (Representing State)
Defendant: Ben Diesel
Investigation #: 5292
Charges:
- 1x Accomplice to Evading - Plead Not Guilty
- 1x Accomplice to Grand Theft Auto - Plead Not Guilty
- 1x Resisting - Plead Not Guilty
- 1x Attempted Escape - Plead Not Guilty
Findings + Reasoning: Let's talk about resisting, if they are chasing you and trying to arrest you - no. If you think you're being unlawfully detained, handle it later. Guilty of resisting. Attempted Escaping does not make any sense at all. They claim you fled lawful custody, but were running away while cuffed. You're not in custody, that's not what custody means. Acc. to Evading doesn't make sense either. The State's only evidence was that they heard the Defendant instructing the driver to drive away, we don't know what was exactly said. That's not going to stick, not guilty. Acc. to GTA, we have you with a CAN injector, according to the State that correlates to the charge, then you ran to the docks and spoke to someone and got paid for the vehicle, this is by definition of Acc. to GTA.
Not Guilty of Acc. to Evading and Att. Escape
Guilty of Resisting and Acc. to GTA.
