To further clarify: Mr. Tsang was detained as he stepped out of a car he was a passenger in that was being hijacked. As he put his hands up to submit to being handcuffed and Officer Kane approached him to presumably do so, Officer Kane reportedly shot him in the back.

Moving forward, as per the guidelines set out by the DOJ, you need to provide proof of service for every civil suit that you file onto the docket. Proof of service means that you have taken a picture of the person being served and that you provide a name of the person who was served.

You also must attempt a settlement meeting before the suit can move forward.

I don't believe that this information about proof of service or the settlement meeting has been readily made available to you after we switched providers and dockets, so I wanted to make sure you were aware of the process.

For simplicity's sake, the Defense acknowledges this civil suit, despite the lack of proof of service, and we wish to arrange a time for a settlement meeting. I will send a text so we may arrange this.

Apologies for the confusion. @Attorney General Uriel Whitlock has apprised me of the situation. I will be entering back into this docket as the representation for Kane and the LSPD.

The State would like to motion to dismiss this case WITHOUT PREJUDICE for the following reason:

This is not an actual filing for a civil suit. There is zero Statement of Claim, there's no proof to back up the damages being requested or where those numbers are coming from. This is all just a quick scribbling of notes that devalues our whole civil suit system and shows that the Plaintiff's Counsel is not taking this very seriously. Miss Li is more than capable of looking through this docket to see how other civil suits have been filed in the past, so I don't think any excuse like "I don't know how civil suits are filed" flies here.

We'd like this to be dismissed without prejudice to be refiled at the Plaintiff's convenience when they have something more respectable put together.

The plaintiff will object to the State's motion to dismiss. Witnesses have been listed, a medical report detailing the treatment after the incident has been provided, and HIPAA request forms are being processed to acquire already completed medical examination beyond that of the initial visit. I've been explicitly instructed to not defend reasoning for relief on the docket by Judge Sparks, so I won't. When I started this suit, there were 3 suits visible on the docket at all and one was my own. The other 2 differ greatly in their filing style. As I've met with more people and received more feedback I've updated the information. What is currently here is a filing that has, to my understanding, everything required; though certainly uncleanly. If this is an insufficient statement of claim under the original posting, then I clearly have a misunderstanding, and I'm more than happy to receive feedback, just like any other aspect of my legal proceedings.

Motion to Dismiss Without Prejudice

The Defense would also like to add to the above motion that the main witness for this trial, Officer Sebastian Kane, has been on an LOA and is not expected back until June 10th or later, as I am being informed by the LSPD. Dismissing this case without prejudice will allow for the Plaintiff to put together a new filing in the time we are waiting for the main witness to come off LOA.

At this time I see no reason for this case to be dismissed. If the main witness to this case is unavailable till June 10th then we will wait till June 10th to start scheduling. As for the issues with statement of claim; It’s clear that this suit is because of a claim of excessive force used against the plaintiff during an interaction with Mr Kane. Finally for the damages. I'm sure we will hear all about Mr Tsangs pain and suffering during the trial.
