Judge Name: Judge Erik Howlett
Clerk(s): N/A
DAO: Alice Winters
Defendant: Liberty Bear
Investigation #: 5456
Charges: Disobeying a Lawful Order
Findings + Reasoning: You can say whatever you want, within reason. That is the beauty of the First Amendment. The problem is that when you start interrupting the duties of an officer, they can lawfully ask you to leave the area temporarily. You can shout whatever you want, but you should give a wide berth to the scene so law enforcement can conduct their duties uninterrupted. Why should the deputy have to move from the crime scene with the witnesses instead of asking someone to leave the area temporarily? Mr. Bear was still in too close of a proximity of a crime scene, even testified to being about 10ft away and didn't leave when told to, they were shouting things at the deputy, the defendant may have been doing their duty as a doorman at the hotal but their duties do not overwrite the duty of the law. They could have just left and returned a few minutes later, but instead, they decided to disobey.
