Magistrate HC Blake Moore entering the docket in Judge Sparks' absence.
On Friday, June 6, Judge Sparks issued a sua sponte order requesting arguments on Summary Judgment. The State then stated they would present their argument within 48 hours. At this time, 4 days have passed and this case has seen no movement. The State carries the burden to prove their case and while I am sympathetic with Ms. Evans' plight and additional evidence presented on this docket, I have no argument to review. Rather than complying with the Court's order, you've presented evidence when we are not in discovery. @Leah Evans I must stress very clearly, please be advised that when you make a representation to this Court, you are highly advised to comply with that representation and the Court's order. While I do not do this lightly, the charges against Mr. Williams will dismissed and he shall be reimbursed for the fine of the charge. I'm confident in Ms. Evans' policing skills that if there are additional incidents that require investigation and charging, she will do so.
With that said, I will also be suspending @Leah Evans 's bar license pending the shadowing of any lawyer for at least 5 bench trials, please seek their advice and counsel in handling the docket and argumentation to the Court.
So is the Order of this Court.
