A rebuttal from my end for the above.

Snowman Chill's accuser is not Elmer Quirk, it is the State. Sergeants Arthur Sharpe and Leah Evans are there to provide testimony on the behalf of all established work done by Captain Elmer Quirk.

As Sergeant Sharpe believes his testimony, along with Leah Evans will stand on their own as per the rebuttal. We move for the following.

Motion to suppress evidence
We move to suppress and strike from the record any and all reports written by Captain Elmer Quirk in relation to this case.
Specifically, reports 4639 and 4637. These reports are filled with eyewitness testimony that we would otherwise wish to challenge in a court of law to prove my client's innocence.

REBUTTAL TO MOTION TO SUPPRESS

Both Arthur Sharpe and Leah Evans have first hand knowledge of all the events included in these reports. The assertion that they are filled with "eyewitness testimony" only attested to by Elmer Quirk is unfounded. The State asks that the court reject this motion outright and questions why we are duplicating motions already made at the pretrial hearing that were overturned by the Judiciary.

Motion to suppress Statements of Captain Quirk DENIED

We will hear Sharpes and Evans testimony. The regular report shall be included in full. However testimony in court will be naturally crossable, and anything lacking first hand knowledge weighed accordingly in evidence, or naturally objected to as lacks personal knowledge.

A regularly kept record and tracking of evidence is still needed by this court. I have no reason to believe a regular police report is so unreliable as to be stricken and not be allowed to show proper chain of custody. Once again, anything not testified to in court will be weighed accordingly, if it seems weak or not properly explained, it will be properly thrown into the trash during deliberation.
Just because Quirk is not here doesn't mean his regular report can not be contested. The State is the accuser.

By the looks of the initial arrest report, Snowman Chill was 'booked' on the 14th of April at 09:48. Factoring in the fact he had spent roughly 2-3 hours in police custody before he was sent to Boilingbroke, I would suggest he was arrested around 07:00. This lines up with the original creation date of Investigation 4639 which contains the main body of the raid evidence and clarification.

MOTION TO PRODUCE

State is now formally motioning for the production of the SIGNED search warrant from this particular incident from the Judiciary. I have tried multiple times during the PC hearing and after for production of this document from the Judiciary and have not yet received it despite confirmation of it's existence.

Chill we we will likely be Tried in Absentia based on his extremely limited availability. He only put in 1 small time slot.
