Motion to suppress Statements of Captain Quirk DENIED
We will hear Sharpes and Evans testimony. The regular report shall be included in full. However testimony in court will be naturally crossable, and anything lacking first hand knowledge weighed accordingly in evidence, or naturally objected to as lacks personal knowledge.
A regularly kept record and tracking of evidence is still needed by this court. I have no reason to believe a regular police report is so unreliable as to be stricken and not be allowed to show proper chain of custody. Once again, anything not testified to in court will be weighed accordingly, if it seems weak or not properly explained, it will be properly thrown into the trash during deliberation.
Just because Quirk is not here doesn't mean his regular report can not be contested. The State is the accuser.
