The state will be motioning for summery judgement in this case, the state believes this case would be an extreme waste of time for the judiciary. The evidence associated with this case is clear Mr Stanley was carrying around a firearm with an obscenely out of date license. Due to his license being out of date the firearm was improperly registered.

The state is charging my client with criminal poss. of a class 1 firearm for allegedly failing to have an up to date license. Not only has it repeatedly been ruled in San Andreas that a simple expired license is negligent ownership and not a Felony possession charge, nowhere in the report is there any indication at all to where this gun was found, who found it, or how. The state has a burden to keep proper documentation of chain of custody for evidence, and an unknown person adding evidence to the locker at an unknown time AFTER it is provided to the defense does not meet that burden.

The court finds it more than reasonable after reviewing the report pertaining to this arrest. The suspect did indeed admitted to the law enforcement officer of having a firearm on his persons. After a initial check of his license it was well out of date as it was issued on the 1/12/25. Licenses expire after 30 days of the initial issued date.

Carrying a firearm without a valid license whether that be expired of revoked is criminal its it not negligent as it is on the persons who is actively carrying that firearm to ensure they are lawfully able to carry that firearm.

The court finds that the grounds for this charge & arrest was reasonable & therefore the charge will stand

Judge-Yee-Atrick Apologies your Honor but i think you might be confused. The report in this case consisted of nothing but a plea of not guilty. When the subpoena was accepted the evidence locker was also empty. It looks like someone may have changed the report well after the arrest and also appears to have removed my access.

I have the report documented as empty, and it was stated in the Subpoena request that the locker was also empty at the time. I have also documented my access having been revoked.

@Sam Burton | James Argento Your subpoena request was updated before this docket got put up which you did not reply to including this the officer involved in the case has stated that they did finish the report and everything else pertaining to this case that very same day. Now regarding the accusation of you being removed from this report that is something that i am completely unaware of.

Judge-Yee-Atrick I think the confusion is between the evidence and the actual report. The evidence was added before I filed the appeal but the report remained blank for multiple days. I can confirm that the last time i looked at the report it was still just a plea. I believe I had last checked on the 26th but as I am no longer attached I cannot even see when it was last changed.

I am almost 100% certain that the report had not been changed until at the very least after the 72 hour window. If you can see the report I would request that you document the last changed date, along with checking the change logs if that is available to you.

Additionally, all the officer said was that the evidence was added the night of, not the report.

I did not receive any notice of a subpoena.
I have had lawyers in the past lie to deputies to be added to open sensitive investigations.

It is my standard that I will remove any lawyers from my arrest records or investigations until a subpoena has been presented to me.
If I am not informed of the request being made, I don't know that access has been granted in an Official capacity.
