Thank you all for your patience. While I understand the plight of standing up for the homeless and sympathize with it, this is not the right way to approach the issue. BCSO provided proof that you both were inside the gas station while the security system was tripped. When they arrived, they spotted you, Emma, with a gun pointed at the clerk and Harper, who had their phone up. They also witnessed the exchange of the bag of money from the clerk to Emma. With that being said, I find you, Emma Banks, guilty of Second Degree Robbery and Harper Banks guilty of Petty Theft. Although they differ in nature, they still both apply here. Deputy France Gall was harsher in her charges.
Next, in a similar circumstance, we have both individuals walking out of the gas station claiming “boredom” and “finished learning to be poor”. I find that a reasonable person would have listened to the commands of the police officers outside and should have immediately complied, allowing them to do their job. Therefore, I find Emma Banks guilty of 1x Resisting and Harper Banks guilty of 1x Failure to Obey a Lawful Order, which, similar to before, differs in terms of severity. With resisting, it is our opinion that a reasonable person would wait instead of walking directly past cops engaged in the robbery. As for 1x Criminal Possession of a Class 1 Firearm, I would also find Emma Banks guilty as she has possession of a gun proven not to be her own. When it comes to false imprisonment, this was the interesting part. The man who was apparently being held up left the scene without giving a statement and whose identity remains a mystery. A reasonable person would have given their statement so there is enough doubt that a victim even exists. Therefore I find you both not guilty of false imprisonment and accomplice to false imprisonment respectively. Finally, we get to felony assault, which, when held alongside second-degree robbery, inherently implies the felony assault and frankly feels like stacking. For this, we also find the defendant Emma Banks not guilty of felony assault.
I believe a crime was done today and I recommend being smarter in the way you advocate for the homeless moving forward. That is the ruling of this court.
As for time, it is court-ordered that they will receive all time served here.
