During the trial we established that an officer did get hit by a wheelchair but what was still unclear was how. Mr. Earl ran into him but there was a lot of information that wasn't presented about the intent to hit the officer or anything else. Just that he was hit. Not only that but Mr. Earl did point out that the alleged victim was not even present at the trial and there was no wheelchair in evidence. Regardless of all that I refuse to believe that a wheelchair can be considered a deadly weapon for Felony Battery on an LEO unless they had picked it up and swung it with great force at someones head.
