Today we heard testimony from both sides testifying to the fact that this was simply an accident, lacking the intent to cause the battery. However, we also heard that the defendant got into the car and on the phone to communicate with his cohort and attempt to pick them up. He got into a vehicle which this court acknowledges as a deadly weapon and headed to where they thought their companion was in a negligent fashion, taking a blind turn at fast speeds before striking the officer. This court finds that the intention behind this individual getting behind the wheel of the car and head towards the other individual is enough to fulfill the second prong of the charge. Therefore, I find you GUILTY of the 1x Felony Battery of an LEO. That is the findings of this court.
