Statement of Indictment:
On June 11th, Magistrate Nym Shaw was noticed in the evidence lockers at BCSO South by Captain Ripley. She was seen unlocking and entering the evidence locker and seen beginning to look through them. A short time after this, the Defendant approached Captain Ripley and asked for assistance in retrieving evidence from a specific evidence report. Captain Ripley complied with the request of the Defendant and provided her with a cannon from the evidence locker. The Defendant thanked the Captain then left the station with the evidence.
The Defendant later called police to report that she had been recently kidnapped and forced to do what her kidnappers had wanted under threat to her life, specifically requesting that she go and retrieve the cannon from a criminal record evidence locker. However, at no point during the time she was within the police station did she contact police, indicate she was in trouble, utilize her radio or phone to communicate she required help, or state to Captain Ripley that what she was doing was under duress to her person.
It is the belief of the State after questioning the Defendant under Miranda that, while maybe not malicious, the negligence shown with the actions of the Defendant rises to the level of criminality due to the sensitive nature of police evidence lockers and her position as a Magistrate within the Department of Justice.
