BRIEF STATEMENT OF RECORDS SOUGHT: I am looking for any photos related to the kidnapping, harming, and potential torturing of Miles Turing AND Sam Burton. Anything that shows either Miles Turing or Sam Burton laying in a pile of corpses with their nipples missing, Turing or Burton inside a holding cell underground, torture chambers with bodies hanging on hooks, and Tim Hernandez taking selfies with Turing and Burton.
PROBABLE CAUSE:
May 31, 2025: Miles Turing was in a parachuting accident at the Banner Hotel, and landed next to two unknown individuals who volunteered to take Turing to the hospital. On their way to the hospital, a red SUV pulled up beside the people taking Turing. The man in the SUV then volunteered to take Turing instead to the hospital, so the two individuals brought Turing into the red SUV and left. The man in the red SUV was referred to as "Tim" and was employed at the Banner Hotel. Tim made an eerie remark saying Turing was "caught in his little web". Turing recalls Tim making a turn away from the direction of Pillbox Hospital, pulling over, placing a black bag over his face, and Tim saying to not remove it "or else". Turing was still incapacitated with two broken legs - but conscious - during this time, so in no way could stop Tim from continuing. Turing recalls Tim taking him to an dark, foul-smelling, sewer-like area, eventually leading him to a prison cell setup. Tim removed the black bag and Turing saw himself being escorted to a room filled with mutilated bodies hanging from hooks. Tim was covered in blood and kept calling himself the "Tomato Man", also using another name "Ping Li". Tim used a switchblade to cut off Turing's nipples while he was fully conscious and incapacitated. Turing also recalls Tim taking photos of him, including one of Turing laying in front of the pile of dead bodies after he cut his nipples off.
June 9th, 2025: Tessa Walker found a photo labeled "Miles 5-31-25" right outside the BCSO South gate. Attached with it was a note that read "For Rob Mist". The photo was of Miles Turing laying in a pile of corpses with his nipples cut off.

June 9th, 2025 (after T. Walker found the "Miles 5-31-25" photo): Tessa Walker receives a call from Siobhan Fitzpatrick regarding Sam Burton being kidnapped from Pillbox Medical. Siobhan was relaying this message from Dr. Nycole Greene, who had called the lawyer line since her 911 calls were not being answered. Thus, Siobhan calling Tessa's cell directly. Tessa received a statement from Nycole who states the following. Nycole Greene and her husband Sam Burton were doing freelancing work when Sam got injured by some locals. Nycole takes him to Pillbox, and just as she is taking Burton out of her car, she sees Tim the Banner manager dressed in a nurse outfit walking toward her. He then says "I got him", proceeds to take Sam, place him into the back of his car, without consent from Nycole, and leave Pillbox. Nycole called 911 several times but no answers came through. This was when she called the lawyer line and Siobhan picked up, to which Siobhan contacted Tessa Walker directly, and Nycole Greene was eventually contacted by PD.
Sam Burton is later found in the Palomino Highlands by a hunter named Lucas Whitmore, who had called 911 to report the body. Burton was found to be naked, covered in blood, and ziptied. Whitmore gave a statement to Deputy Jen Saito who was first on scene. Burton was later transported to Pillbox Hospital where he underwent surgery and was in ICU until the following day, where he then gave a statement to Deputy Arthur Sharpe on what happened.
June 10th, 2025: Sam Burton wakes up from ICU and gives Deputy Sharpe his statement. Burton explains he was with Nycole Greene doing a job for a local. He was wacked on the head, so Greene took him to the hospital. On the way, he fell unconscious. When he awoke, his hands were ziptied and had a black bag over his head. After 10 minutes of laying on a concrete floor, a man comes in and greets himself. He says "I'm here to help you". The man helps Burton onto his feet, walks him somewhere, and drops Burton down a hole. Burton was walked around a little more by the man where he then put him into a holding cell, eventually having the black bag taken off. Burton described the area as an old, moldy, underground area that smelled of blood. Burton says the man was wearing a nurse outfit at first, but left him alone for a few minutes still ziptied, came back and was wearing a button-up shirt, tie, and slacks. Burton immediately recognized the man as the Banner Hotel manager Tim Hernandez. Tim taunted Burton, robbing him of his katana and ripping his shirt off. Burton recalls Tim taking him out of the holding cell and toward a tarp with at least 4 dismembered bodies on it. Burton is forced to dance on the pile of bodies before Tim leads him to a torture room, swings Burton's katana around, and cuts off Burton's nipples with the katana. Burton plead Hernandez for him to leave, to which Hernandez agreed. Burton then felt his sword pierce through his back. Burton looked down and saw his sword was coming through his abdomen. Burton then woke up in the ICU.
June 18th, 2025: I, Deputy Jorkin Da'Peneaux, received an anonymous phone call while at BCSO South. The caller says "did you find the bodies yet?" The caller refused to answer who they were, but it was a male trying to disguise their voice. The caller brags over the phone that they will never be caught, there will be more victims, and that they left a "gift" in front of MRPD. After the call ended, I went to MRPD and saw a note on the ground that said "Rob Mist couldn't stop me. there will be more", paired with a photo labeled "Sam 6-9". The photo was of Sam Burton laying in a pile of corpses with his nipples cut off. I read through Burton's kidnapping report, and proceeded to contact him and any victims/witnesses involved.

June 25th, 2025: I, Deputy Da'Peneaux, have finally contacted Sam Burton and re-interviewed him. In the interview, he confirms he knows the Hotel Manager Tim Hernandez by stating "Ya, he kidnapped me and almost killed me 2 weeks ago." I show Burton the photo labeled "Sam 6-9" that was found at MRPD, and he confirms that that is him, and the pile of corpses was where he was forced to dance by Hernandez. Burton doesn't remember laying on the bodies, but he does recall standing and dancing on top of them whilst ziptied. While looking at the "Sam 6-9" photo, Burton described how directly behind the camera's POV was a torture chamber, to the left was a long hallway with holding cells on the right side, and at the end of the hallway was where he first entered through this "hole" he was dropped from on June 9th. Burton even drew a diagram of what Tim gave him a tour of.

June 25th, 2025 (later that day): I, Deputy Da'Peneaux, was continuing to re-interview the witnesses and victims of Sam Burton's case when I eventually got to Tessa Walker, who took the initial phone call of Burton being kidnapped. Walker granted me access to the "Miles 5-31-25" photo from June 9th, as both Burton being kidnapped and the Miles photo being found were on the same day, but some time apart. Upon viewing this "Miles" photo, I noticed it was taken in the exact same place Burton's photo was taken in. I read through Turing's kidnapping report and Turing clearly states in the interview with Deputy Rob Mist and Adler that he recalls Tim taking photos of him, including one of Turing laying in front of the pile of dead bodies after he cut his nipples off. Now, just to make sure that I was not getting the wrong "Tim", I noticed he said "Tim" referred to himself as "Tomato Man" and "Ping Li". I checked Hernandez's profile and it states his other known aliases as "Bobcat Tim, Tomatoe Man, and Ping Li, & now Jacoby". It also states on his profile he is the General Manager of the Banner Hotel:

June 27th, 2025: I, Deputy Da'Peneaux, finally got in contact with the head of BCSO Dispatch Gwen Pepper to see if she knew anything about Tim Hernandez. Gwen has had plenty of run-ins with Hernandez that I have personally taken statements from her and put them in investigations. Out of curiosity, I asked her if Tim went by any other names. And immediately Gwen responded with "Tomato Man!"
Based on the investigations above, I believe I have hard evidence that Tim Hernandez is storing photos inside his cellphone's photo gallery of his kidnapped victims - Miles Turing & Sam Burton - being tortured. I believe it is important to access these potential photos from the listed dates above as both May 31st and June 9th were the days the two victims reported their respective incidents to have occurred. Both victims had their photos taken in the exact same pile of dead bodies, with Miles Turing himself stating he remembers Hernandez taking photos of him on the pile. Sam Burton also states he remembers standing on top of the exact pile he was shown a photo of. If Tim Hernandez is found to be in possession of these potential photos in his personal phone's photo gallery, it can further push the investigation into better understanding the full picture of what damage Hernandez may have caused.
