Today we heard a case where I think some of us all have similar thoughts. What happened here was fucked up. And as the State stated in their closing, LSPD is clearly fucked. Officers are held to a high standard given that they have the full power of the State and the arresting arm and powers granted to them by the State. What we heard today was a statement by Wrangler of Mrs. Topp in the prison, but not charged. Then the defense presented testimony from a SAMS command member who passed the buck to DOC, who perjured himself, and also passed the buck to LSPD and finally the Chief of Police who also passed the buck. But who is responsible here? In a world of Spidermen pointing at each other, who fucking did it.
In looking at the evidence and testimony for Khai Shaw, all we have is that he wrote a warrant. Nothing else was presented by the State. The only other thing here is that a mysterious individual for the LSPD ordered this transport, we do not know who that is. For that reason Mr. Shaw will be found NOT GUILTY on his charges.
We then turn to Rafael Cortez who is not involved at the original incident at the hospital, but was later contacted by BCSO when Mrs. Topp awoke in ICU inside the prison. At that time, it is not disputed that any investigation occurred and Mr. Cortez pressed the warrant against Mrs. Topp and sent her to prison a second time. This included a charge not included in the warrant, a First Degree Murder charge, a HUT. Thereby confining her to the prison indefinitely pending trial. An officer is held to a high standard to arrest individuals and detain them and send them to prison. Here, it is undisputed and without reasonable doubt that kidnapping DID occur at the time the arrest was effectuated. Guilty of kidnapping. For corruption, we must meet two prongs. An abuse of authority, this is easily met through the kidnapping. The other, gross negligence, requires a conscious disregard to potential harm or reckless or wanton behavior...knowingly sending someone to prison when you are made aware they have already been in prison without conducting any sort of investigation or otherwise to determine whether they need to stay there is in fact gross negligence. Guilty on Corruption.
Rich Randy will be charged with Perjury in light of his testimony and Bill Smith shall be charged with Failure to Appear for not appearing at this case or providing a reasoning on the docket.
