Response to the Court and Motion for Joinder
Honorable Lars, While the officers in this case appreciate the offer put forth by yourself, we must respectfully decline as we find potential conflict with the defense of the case and the potential necessity of calling you as a witness as we prepare our strategy.
Presently, the appeals are filed under two distinct criminal cases involving Officers Khai Shaw and Rafael Cortez, which share similar legal issues and overlapping factual circumstances. LSPD Legal hereby moves for joinder of these cases, such that both defendants can be tried together. This motion is made in the interest of judicial efficiency and to preserve legal resources.
Both defendants, Khai Shaw and Rafael Cortez, have independently consented to this joinder. Combining these cases will streamline proceedings, avoid duplicative litigation, and promote consistency in the Court’s determinations.
Requested and Required Actions:
- Motion review and approval by the presiding Judge.
- Assistance from the Clerk of Courts to join the cases on the docket, if possible.
