Reason for Suit: On June 10th, Captain Ripley was pursuing an individual on a moped. The moped began to leak gas, and blew up while going up a staircase. As this was happening, Tim Hernandez approached in his vehicle, having to swerve around the literal line of fire from the ignited gas, and stopped against a wall at legion square to wait out the situation and avoid danger. The fleeing perp hops in Tim’s car, and urges him to drive. Tim does not move at all, and remains silent. The perp gets out, and continues to run. All other deputies chase the perp, but Ripley remains. Ripley kicks Tim’s driver side door several times, denting it significantly. As Tim drives away, Ripley follow along for a short few moments, yelling ‘I’m gonna get you”, before speeding away to continue the chase. About 5 minutes later, while Tim is in the hotel lobby which he manages, Ripley speeds into the hotel lobby at speeds of about 40 mph, going up and down stairs, and doing burnouts in a lobby with at least 5 people in it. Tim is forced to raise his firearm to forcefully ask Captain Ripley to stop, after which Ripley radios for help, and Tim is arrested. Tim’s raising of his weapon has been ruled as an act of self defense. We believe this constitutes a tort of Negligence, Assault, Infliction of Emotional Distress, and Trespass of Property
