Noting that I was attempting to get a Bail Hearing for the past two hours. Judge was available but no DA available.
We are requesting if possible a summary judgement with DA input at this time for the client.

The State would request the following conditions:

No Weapons, including blunt objects like bats, knifes, machetes, guns, ect.
No Drugs or Alcohol
No Misdemeanors or Felonies
Subject to a Frisk no more than 3 times a day without probable cause/reasonable suspicion.
No access to the Eclipse Towers, especially the Defendants owned properties.
Bail amount set at $750,000 with the usual 10% payable now.

The state has no other special requests for bail.

Rebuttal to The State
The Defendant needs access to his Eclipse Tower property (not the rentals on Level 8) due to the paperwork being stored there and it being where he lives. He doesn't own any other property and would be left out on the streets if that was granted. The State has seen some of this paperwork and knows this.

We believe that a bail amount closer to $250,000 is more reasonable knowing this case is about items found in renters apartments (of which he will provide paperwork once released from prison and was not afforded the chase to produce prior), not my own clients apartments.

Rebuttal to The Defense
Considering that Chill would have received a Manufacturing of Weaponry and Weapon Trafficking HUT's just based off of the belongings in room 232, in which he is claiming as his own, I don't believe that he should have access to that property for the time being as well. The BCSO also seized any type of "paperwork" that was within that room.

Given that all of the rooms are still very much apart of an active investigation and that Chill can access the government housing at the hotel, I think it's a given that he shouldn't be allowed to return to what is essentially still an active crime scene.

We will be presenting to the Defendant the following bail conditions:

  • $350,000, whereas 10% is to be sent to the Department of Justice account to be held in-trust until such time. As it is clear the Defendant has a negative amount, that means they will need to pay $35,000 directly from their account. I would like to see documentation on where this money came from should they present bail. That being said, it could be a signed affidavit by an employer, loan provider, et cetera. I will not play games here.

  • No firearms of any kind, including items related to the manufacturing of firearms, firearm shaped objects that could be easily confused as a firearm.

  • No conviction of any misdemeanor or felony. A "No Contest" or "Not Guilty, appeal later" intention will also violate this bail. Traffic Citations okay.

  • Defendant will be subject to a frisk no more than once every 24 hours.

  • Defendant will be subject to have a property search of vehicles and home once every 24 hours while the Defendant is present for the search of these properties. We will not be restricting someone from their own home because of crimes alleged by the State.

The Defendant will have 24 hours to determine if they accept these bail conditions, and should they accept payment is to be made immediately to the Department of Justice's account (10000002).

These Bail conditions are dismissed due to the 4th Amendment violation with not sharing the report with counsel within the 72 hours.

Mr. Chill is Court Ordered to attend trial instead.

The $35,000 paid in escrew to the DOJ is to be refunded to the Defendant at his earliest convenience.
