Reason for Suit: Mr. Hernandez was arrested and held for approximately an hour and a half on the evening of May 28th 2025 by the LSPD. Mr. Hernandez remained in an interrogation room for approximately 30 minutes before he was informed of charges against him. Immediately, defense counsel and Mr. Hernandez made it clear that they would be pleading not guilty and wished to have a Bench Trial. After some brief questioning, counsel and Mr. Hernandez were escorted to the cells, where they waited for approximately one additional hour, with the only communication regarding any prosecution from the LSPD being that they were ‘finalizing charges’. One hour and a half in total later, and the LSPD informed Mr. Hernandez and counsel that Mr. Hernandez was free to go. The plaintiff alleges that this event constitutes a false arrest, and alleges that there was no probable cause for the arrest. The length of this arrest resulted in a significant loss of profits to Mr. Hernandez; a notable loss of reputation, as this is one of the most serious accusations against Mr. Hernandez in a long line of fruitless arrests of Mr. Hernandez, which is exasperated by the publicity of the arrests, Mr. Hernandez’s elderly age and his corresponding ability and time to repair his reputation, and the value of a good reputation in Mr. Hernandez’s line of work; significant emotional distress, as Mr. Hernandez keeps being arrested while lawfully and peacefully performing his duties at the Banner Hotel, and the repeated unfounded accusations of such horrible things weigh heavily on his psychiatric health.
