Provide reasoning for appeal: This is an appeal to the corresponding bench trial. We believe that Mr. Hernandez satisfied the four prongs of Self Defense for Castle, as we allege that Captain Ripley was performing an attack that was causing a risk of death upon the denizens of the Banner Hotel, and that there exists established law by large amounts of ruling that striking someone with a vehicle is assault with a deadly weapon, and as such the defense argues that its perfectly reasonable to assess a speeding motorbike inside with very little room to as a deadly weapon. Also, due to the nature of a personal physical attack in very close temporal proximity to the incident at hand, the defense believes it very reasonable for Mr. Hernandez to assess this as purposeful hostile act by Captain Ripley. This, we believe satisfies the first two prongs of Castle, and of course responding to deadly force with display of deadly force is reasonable. The fourth prong, is immediately satisfied, as Mr. Hernandez immediately interacted with law enforcement, and was apprehended before he could interact with law enforcement outside of the topical situation. We also believe that the burden of proof was applied in a wrongful nature to the defense.
