The Defense Motions for Dismissal of all charges against our client with Predjudice.

Firstly, this case involves several DAs whome are now quit or on LOA mid plea discussions. This lack of presence and mindfulness is causing a 6th Ammendment violation towards the client right to a Speedy Trial.

Murphy just on another case had said she would get a plea deal out before LOA and and then failed to do so for ours. Our client is being excessively punished for this investigation hanging over her head.

Finally, for such serious charges, it is extremely inappropriate for the state to lack consistant communication or attempt to drive the case forward. With the collapse of the DAs Office, these charges have no State actor wishing to complete them. These were not even pushed by an officer directly. The AG pushed them and then DIDNT complete them. What the crap is that.

In the words of a judge whome I have great respect for: "FINISH YOUR OWN DAMN CASES."

The State still has an interest in prosecuting this matter. We are in discussions with the defense over a possible plea. I require some time to speak with the people involved in this matter to have an understanding of what happened, before I can feel confident in offering an agreeable plea.

Motion to Drop Charges for Want of Prosecution:

The Statute's up. Its 11 days before today that the state has failed to prosecute this. The last action before that is 24 days ago. We can't let Ms. Shaw's life, and her duties, be thrown into a quagmire by the inability of the State to prosecute this case. Even before the dissolution of the DAO, this case was still failed to be prosecuted for 95% of the statute. Not even any LEOs wanted to prosecute this. Counselor Lars and I meet frequently over this case, and frequently reached out to the DAO over this. Your honor, the defense would argue that we cannot reward this lethargic litigation with even one more day of keeping Ms. Shaw from performing her thankless, and frankly irreplaceable, duties for the DOJ. Not with this prosecution. Not for this crime. Not for a mere indictment. Not for something she did under threat of life and limb not only to herself, but also countless others. I implore you your Honor, please let Ms. Shaw return to her duties.

Rebuttal

We have given every leniency to Ms. Shaw. Not only has she not been arrested, but this was pushed to the criminal docket instead of made an appeal. This special privilege was only given to her because she is a judge, and quite frankly, I don't agree with the decision to give her special treatment.

She has been on duty and getting paid by the DOJ this entire period. I find it ridiculous that Ms. Shaw is suffering any kind of "special punishment".

Lis Bajek Indictments are a matter of course for Corruption. Basil Candig and Cheeno Winters, both simply low level Rangers, also received this 'special treatment'.

And just like Clockwork, Liz Bajek is no longer the AG in the MDT or by reports of deputies, and therefore is no longer apart of the office that initial pushed the charge, the now defunct DA's office.

Once again, no participation from the state. Also past Statute of Limitations for a new attorney entering.
