One of the key witnesses for this trial - Bernie Wernstein - will not be available until after Sunday July 20th. Would it be possible to depose Bernie ahead of the trial date, either tonight or Monday night, and have that admissible?

If not, then I would like to make a motion to delay the trial until after July 21st.

Cassian Rose The State is confused as to why an individual who has not been called as a witness, and is not a material witness, is being called for deposition.
