@Aiden Kerr To be clear, was your lawyer witness to the arrest incident? They should not be a witness and advocate simultaneously. Her testimony would not be protected by the 5th (as far as I am aware she has no upcoming possibly incriminating testimony), and she can not properly advocate for or against the evidence (herself) unless you agree that the testimony she provides for an uncontested issue.

@Theodore Lars Your Honor, No. She did not witness the event that landed me in hand cuffs, she was no where near me, nor the area that the incident occurred. My attorney was present at the hospital, and upon me waking up from being incapacitated she advised me to remain silent after a potential spontaneous utterance - there was less than a 30 second overlap. She was called by Bloom down to represent me in the cells, and then later he determined that "if this is going to bench I'm going to call Storm as a witness so you won't have a lawyer or need to find a new one."

When she is able, she can tell you in full the extent of her "involvement" or to another judge as not to conflict you.

I am going to be honest all this is sounding like someone may have just declared themselves the attorney mid investigation after seeing the start of an investigation.

@Louis Bloom I assume the witness is important to verify what the defendant said under questioning. Is that all? Is there other actions by Storm or the defendant she would be testifying to? (Just give the topic of relevance please, weighing in how informed the defendant is to the criticality of her testimony)

First note: Discovery is open through tonight if you need it.

Secondly, Ill allow you to be counselor and witness as long as someone else with a BAR can queation or cross yourself or represent the defendant if somehow the testimony is against his interest. We can discuss your relevance pre trial on the day of court if you believe you can be stricken. Ide rather not entirely remove you based on what has been described because I dont have a solid indication your testimony would prevent proper advocacy of the client.

We'll see you on the court date or deposition. Let me know if anything else comes up before trial.

Apologies for the delay, I was in the hospital and just released.

My name is AUDREY. I did not witness the alleged crimes committed. I only saw Mr. Kerr in the hospital and advised him to stop talking, as was his right. I was then called by Deputy Bloom to come down and represent Kerr.

As far as names, Counselor Audrey, your first vs last name (Full or partial), or whatever you prefer just let me know at the court date. Old habits for Officer or Deputy and last name die hard. As with any lawyer, speak up during trial if I say it wrong.
