On behalf of the Los Santos Police Department (LSPD), we respectfully submit the following notice regarding multiple procedural deficiencies affecting this matter:
While the case was reportedly filed and served on July 16th, 2025, the LSPD was not properly tagged or notified during the scheduling process initiated by the Court.
Under the Civil Scheduling Rules, when suing a government agency, Plaintiff’s counsel must tag the officer involved and the department to notify the agency. Additionally, the Court’s scheduling notice must include direct notification to the department to ensure fair opportunity to respond within the 72-hour requirement.
LSPD did not receive timely or formal notice of the scheduling window, and therefore has been unable to respond or provide availability in accordance with Court procedures.
Given these facts, we respectfully request:
That the Court recognize the lack of proper notice as an exceptional circumstance, and reset the scheduling timeline starting from the date of proper tagging/notification ( today 7/21/2025) that would allow the final scheduling date to be completed (7/31/2025).
We also ask that any motion for Default Judgment be dismissed or held in abeyance pending resolution of this procedural error by the court and plaintiffs' legal team.
