From the defense's perspective this case won't be ready for trial for some time. We are still waiting for a plea offer from the AG and discovery is incomplete. If a plea doesn't resolve the case it's quite possible a pre-trial hearing will be necessary as well. Additionally this is a rare case where if it's goes to trial the defense may need to try to conduct its own investigation depending on what shows up in discovery.

Is there any update on this case @Barry Honist ? It has been pending for 19 days and no movement in some time. Before putting this back into scheduling I'd like to know if the Defense is prepared.

The Defendant is still hoping this will be resolved with a plea agreement. That said, the defense is prepared to begin scheduling trial so he's not left in limbo if a plea can't be reached. Assuming a plea isn't reached, we'd also like to schedule a pre-trial hearing on a motion to suppress evidence from one of the raids in this case, combined with a PC hearing on the two weapon related HUTS that stem from that raid. The defense won't need the defendant for this pre-trial hearing and I anticipate that I will need less than 10 minutes of the Court's time to present argument. (though of course the State may wish for more time or witnesses).

So ideally from my perspective a pre-trial hearing would be scheduled early next week with a trial scheduled as soon afterwards as everyone needed has their schedule lined up on a new calendar. That gives the parties enough time to complete plea negotiations if it's going to happen prior to the hearing.

Hello your Honor, I am happy to say that the the parties have agreed to a plea in this matter. We will work to get the official document drafted and in front of you to review. I believe the major points will be that in exchange for a guilty plea, the State will recommend 6 years in prison with no credit for time served prior to the agreement, a 100k fine, and the seizure of a Dominator GTT, a Hexer, a Tropic (this is a boat), a Lycan, a Lycan 2, and a Hellfire.
